Purpose of Platform:

The purpose of this platform (“Platform”) is to facilitate the filing of GAP claims, to provide information needed to process existing GAP claims or to check on the status of pending GAP claims. The content and material available to financial institutions (“Lenders” or “You”) via this Platform is for informational purposes only. The contents of the Platform do not constitute advice and should not be relied on in taking, or refraining from taking, any decision or action. Under no circumstances shall truWarranty be liable for direct, indirect, or incidental damages resulting from Your use of information on the Platform.

Your Representations:

By clicking the submit button, You represent that (i) You are the Lender to each GAP customer for which You are utilizing the Platform; (ii) You are legally authorized to file a GAP claim, provide information needed to process a GAP claim or check on the status of a GAP claim by each of your GAP customers; (iii) all information that You provide on the Platform is accurate and true to the best of Your knowledge; and (iv) Your use of the Platform will not violate any federal or state law, ordinance, charter, by-law or rule applicable to You, or any other agreement by which You are bound. If these representations are not accurate, please do not use the Portal.

Use of Platform:

You are solely responsible for maintaining the confidentiality of your Lender ID and Password, and are fully responsible for all activities that occur under your Lender ID and Password. You shall use all reasonable efforts to ensure that no unauthorized person will or could access the Platform using Your Lender ID or Password. You agree to (a) immediately notify truWarranty of any unauthorized use of your Lender ID or Password or any other breach of its security, and (b) ensure that you properly exit the Portal at the end of each session.

Consent to Email:

You agree that, by clicking below, Lender is consenting to receive updates about its GAP customers' claims via email.

Responsibility for Providing Requested Documents:

You acknowledge that the GAP Administration Department will not gather the requested documents but, rather, the GAP customer is responsible for obtaining and submitting any necessary claim documentation to the GAP Administration Department. Failure to provide the required documents or additional requested documents may cause a delay in the processing of a claim.

Deadline Within Which to Provide Documents and Complete Claim:

You understand that there is a time restriction in which to submit a GAP Claim and that the completed claim information form must be provided within ninety (90) days of the Total Loss Settlement or within ninety (90) days from the Date of Loss if the vehicle is not insured, whichever is later, or the claim will be denied.

Termination/Access Restriction:

truWarranty reserves the right, in its sole discretion, to terminate Your access to this Portal at any time, without notice.

Acknowledgement:

By using this Portal, You accept these terms of use. If You don't agree, Your remedy is to stop using this Portal. truWarranty may update these terms of use from time to time, so You should revisit each time You use this Portal.
